Job Summary:
This is a fully-remote, senior-level, in-house Legal Counsel position that will be primarily responsible for various litigation matters ranging from extraordinary commercial, tort and IP litigation, to litigation that arises in the ordinary course of business operations, including commercial disputes, customer nonpayment, contractual interpretation and enforcement, and the enforcement of post-termination contractual obligations. The Senior Counsel, Litigation will have a working familiarity with a variety of litigation matters from IP infringement, violation of contractual agreements, and complex corporate business disputes.

Responsibilities:

Our ideal candidate has demonstrated experience with corporate litigation and dispute-related matters, either in a law firm and/or in-house setting, with a strong understanding of litigation strategy, risk assessment, and regulatory response. They have demonstrated experience advising on litigation exposure, working with and managing outside counsel, and partnering with internal stakeholders across the organization in a fast-paced, dynamic environment. The ideal candidate brings excellent legal judgment, strong business acumen, and a proactive, solutions-oriented approach to navigating small and complex disputes. After an initial onboarding period, the Senior Counsel, Litigation must operate as a self-starter, applying their expertise to identify, manage, and mitigate legal risk through practical application of Toptal’s policies, processes, and procedures. The ability to assess risk, balance competing interests, and deliver clear, concise, and actionable guidance is critical to success in this role. You will also play a key role in developing, refining, and maintaining internal litigation management processes, guidelines, and best practices.
Like all roles within Toptal’s Legal department, it requires collaboration with others across many functional areas, but ultimately will entail hands-on work more than managing the work of others. It is expected that the Senior Counsel, Litigation will cultivate productive relationships with internal and external business partners and foster a customer-centric approach that is simultaneously protective of Toptal’s legal and business interests and reputation.
In the first week, expect to:
· Onboard and integrate into Toptal and the team.
· Obtain an understanding of organizational tools and processes.
In the first month, expect to:
· Begin to familiarize yourself with our best practices relating to client policies, employer agreements, and our current process on how to handle disputes of all sizes.
In the first three months, expect to:
· Begin to take on litigation and dispute cases with increasing levels of responsibility and complexity, with a focus on familiarity with recognizing and implementing Toptal’s best practices and contractual agreements.
· Develop strong personal relationships with other Legal team members and with external counsel in order to help drive best practices in Toptal’s current litigation and dispute resolution process.
In the first six months, expect to:
· Be prepared to lead litigations and disputes, with a focus on resolutions that are in Toptal’s best interest.
· Assist the General Counsel and external counsel with high profile litigation matters.
· Provide ongoing advice on day to day litigation matters, while exercising discretion and independent judgment.
In the first year, expect to:
· Be viewed as a go-to expert in the litigation space.
· Continue to identify areas to improve efficiency and uplevel the speed and efficiency of the litigation and dispute resolution process.
Qualifications and Job Requirements:
· Juris Doctor degree, LLB, LLM or equivalent is required.
· Admission to a U.S. State or the District of Columbia bar.
· Minimum of 5 years of experience focused in litigation, ideally some of that experience being in a law firm setting.
· Ability to assist the General Counsel and other in-house legal team members and external counsel on various litigation matters, including review of discovery productions, legal research, motion practice, and appellate work, as the need may arise.
· Experience enforcing contractual terms for customer payment obligations and enforcing post-termination contractual obligations of personnel.
· Excellent customer service (internal and external), interpersonal, and organizational skills.
· Ability to quickly master and integrate legal, business, technical, and practical analysis.
· An extremely sharp eye for detail with exceptional business judgment and a knack for coming up with creative solutions.
· Ability to support and scale in a fast-growing company with a focus on execution.
· Outstanding written and verbal communication skills.
· Ability to work in a fast-paced, rapidly growing company and handle a wide variety of challenges, deadlines, and a diverse array of contacts.

US FLSA Classification: Full-Time/Exempt
