Agency Attorney

TLDR

Conduct confidential investigations regarding EEO violations and workplace violence, providing legal guidance and reporting on DSNY’s EEO program implementation.

The Department seeks one Agency Attorney (Level II) to join its Office of Equal Employment Opportunity & Workplace Violence Prevention (“EEO-WPV”). The Agency Attorney (Level II) will conduct confidential and highly sensitive investigations concerning alleged misconduct and violation of the City’s EEO policy and DSNY Workplace Violence Prevention Policy by DSNY officials and/or employees. Working directly with the Executive Director of EEO-WPV and the Director of the EEO Unit, the Agency Attorney (Level II) will interview complainants, respondents, and witnesses; examine and analyze employee records; maintain case records; and prepare and review written investigative reports. The Agency Attorney (Level II) will also interpret rules, regulations, and policies pertaining to DSNY and the City of New York. Under general supervision, with some latitude for independent action and decision, the Agency Attorney (Level II) will perform work requiring a high degree of specialization and technical expertise.

Responsibilities include:
- Investigating complaints of unlawful discrimination and violence in the workplace
- Preparing written reports of investigations for internal complaints
- Reviewing reports written by non-attorney investigators to ensure accuracy and completeness
- Reviewing requests for reasonable accommodation, including by engaging in the cooperative dialogue and drafting determinations
- Maintaining organized case files of investigations and reasonable accommodations
- Collecting and maintaining data regarding internal complaints, reasonable accommodations, and training activities
- Preparing quarterly and annual reports regarding DSNY’s implementation of its EEO program, as well as other ad-hoc reports
- Providing advice and guidance to employees and management regarding difficult workplace situations
- Conducting legal research on equal opportunity laws and regulations
- Recommending areas for policy improvement to prevent discrimination and workplace violence
- Conducting trainings and seminars for employees at all levels on Department policies and applicable laws related to equal employment opportunity and workplace violence prevention

AGENCY ATTORNEY - 30087

1. Admission to the New York State Bar; and either "2" or "3" below.
2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or
3. Six months of satisfactory service as an Agency Attorney Interne (30086).
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
In addition to meeting the minimum Qualification Requirements:
To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
