Position Summary:The Compliance Counsel will report to the Chief Compliance Officer and will assist both the Chief Compliance Office and Chief Legal Officer with responsibilities in oversight of the Compliance and Privacy Programs and other legal activities. This will include, but not be limited to, research on applicable laws, rules and regulations, contract drafting, negotiation and review, revising policies and procedures, assisting with internal/external audits, assisting with training material and risk assessments. The Compliance Counsel is also responsible for assisting with projects, while at the same time handling day to day business matters.
Responsibilities:
- Draft and negotiate contracts with vendors, clients, contractors, providers and any other third party entities for the organization
- Provide legal support to the Chief Compliance Officer and Chief Legal Officer
- Provide legal advice on issues related to compliance with state and federal laws and regulations and the impacts to the organization
- Identify and analyze the latest regulatory and legislative proposals and the impacts to the organization
- Support and assist with internal audits, risk assessments and external audits
- Manage and keep compliance training materials current and trending with the organizational needs
- Coordinate with Account Management on client contract
- Recommend practical, effective mitigation strategies to address and mitigate regulatory risks
- Maintain proficiency and deep expertise in HIPAA, HITECH and applicable state privacy requirements
- Maintain proficiency and deep expertise in CMS regulations including but not limited to, state and federal
- Develop and maintain working relationships with various departments
- Lead company-wide responses to certain regulatory inquiries, investigations, and audits
- Perform other duties assigned
Requirements:
- JD from accredited institution
- Active bar standing in the US
- 5+ years of regulatory experience
- Experience in researching and analyzing state and federal law and regulations
- Comprehensive understanding of HIPAA, HITECH and state privacy requirements
- Detail-oriented, self-motivated and strong work ethic
- Come to headquarters, once a quarter for onsite team meetings
- Proven track record of ability to draft and negotiate contracts and execute on other business relationships
